Terms of Service & Privacy Policy

1.Who We Are & Agreement to These Terms

Make Lucky (the “Platform”) is operated by Purnendu Gharami, an independent software operator based in Bangladesh (“we,” “us,” or “our”). You can reach us at codeliminal@gmail.com.

By accessing the Platform, creating an account, discovering a Star, submitting a Star, or purchasing any paid subscription or utility credit, you (“you” or “User”) agree to these Terms. When you submit a Star or complete a purchase, you also confirm your agreement by ticking the acceptance checkbox. If you do not agree, do not use the Platform.

2.Definitions

• Star — a creator listing on the Platform consisting of an approved destination URL plus the title, description, category, genre and metadata you provide.
• Draw (or “Explore / Stumble”) — the free software feature of receiving a serendipitous, randomly selected Star from the 3D galaxy and, if you choose, visiting its destination URL.
• Destination — the third-party external webpage or repository a Star links to.
• Stardust — a non-monetary SaaS usage credit used within the Platform to unlock additional Star listing slots or extend a Star’s active indexing duration in the galaxy.
• Premium — an optional paid SaaS subscription tier that provides additional active Star slots, profile customization, and discounted Stardust usage rates.
• Karma — non-monetary community participation points earned by exploring and supporting other creators’ Stars, used for community leaderboards. Karma has no cash or monetary value.
• Paid Features — Premium subscriptions and Stardust utility credit packs purchased for real money.

3.Eligibility, Minors & Accounts

3.1 Who may use the Platform

The Platform contains only general-audience content (adult/NSFW content is strictly prohibited — see Section 5), and anyone may browse and explore Stars. However:

1. If you are under the age of legal majority where you live (18 in most jurisdictions), you may create an account, submit Stars or purchase Paid Features only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use and for any purchase.
2. If you are under 13 (or the minimum age for digital consent in your country, such as 16 in certain EU states), do not create an account or submit personal information. If we learn we hold such data without verified parental consent, we will delete it.
3. You may not use the Platform if you have been previously banned or if doing so violates the laws of your jurisdiction.

3.2 Your account

1. Provide accurate account information and keep it up to date.
2. Keep your login credentials secure. You are responsible for all activity under your account. Notify us immediately at codeliminal@gmail.com if you suspect unauthorised access.
3. One person, one account. Creating multiple accounts to obtain extra free Star slots, inflate Karma, brigade abuse reports, or evade a suspension is strictly prohibited.
4. You may delete your account at any time by emailing us. Deleting your account permanently removes your Stars and forfeits any unused Stardust or remaining subscription period without refund (see Section 10).

4.How the Platform Works & Our Role

1. What we are. Make Lucky is an interactive 3D software directory and serendipitous discovery index that displays links submitted by creators. We store the Star metadata you submit (URL, title, description, category). We do not host, create, control, or continuously monitor the content on external Destination websites.
2. No endorsement. A Star appearing on the Platform or on any community leaderboard is not a recommendation, endorsement, or guarantee by us of the Destination, its creator, or any software, product, or service it offers.
3. Third-party sites. Visiting a Destination takes you off the Platform to an external domain governed by its own terms and privacy policy. You access third-party Destinations entirely at your own risk.
4. Intermediary Safe Harbor status. We act strictly as an online intermediary and indexing directory for User-submitted hyperlinks. Where applicable, we rely on the legal safe-harbor protections afforded to intermediaries and online indexing tools globally, including Section 230 of the U.S. Communications Act (47 U.S.C. § 230), Section 512(d) of the U.S. Digital Millennium Copyright Act (DMCA), the EU Digital Services Act (Regulation (EU) 2022/2065), and equivalent international intermediary liability laws. Our good-faith automated filtering and moderation do not make us the publisher or author of User content.
5. Algorithmic discovery & non-gambling notice. Discovery Draws are a free software browsing mechanism weighted by category preferences, active indexing status, and community participation (Karma). Make Lucky is strictly a creator discovery software tool — it is not a lottery, raffle, sweepstakes, auction, or game of chance, and Users can never win money or prizes of monetary value. We do not guarantee any specific number of views, Draws, clicks, or outcomes for any Star.

5.Acceptable Use & Content Policy

To keep the Platform safe for everyone and to comply with international laws and the Acceptable Use Policies of our payment providers and card networks, you must not submit a Star whose title, description, or Destination contains, promotes, or redirects to:

1. Adult or sexual content (Zero Tolerance): nudity, pornography, sexually explicit text or imagery, erotic fiction, hentai, escort, dating/cam or “18+/NSFW” pages, or adult subscription links (e.g., OnlyFans, Fansly, NSFW subreddits, or adult social media accounts).
2. Child safety violations: any child sexual abuse material (CSAM) or content that sexualises, grooms, or endangers minors. We report violations to law enforcement and NCMEC.
3. Malware, phishing and deception: viruses, spyware, crypto/wallet drainers, fake login pages, deceptive downloads, cloaked redirects, URL shorteners, or a Destination that misrepresents its true nature.
4. Gambling, crypto schemes and financial fraud: casinos, betting, sportsbooks, lotteries, paid sweepstakes, loot boxes, Ponzi/pyramid/MLM schemes, “get rich quick” offers, unregistered financial/trading signals, or crypto/NFT token launches.
5. Illegal or regulated goods: drugs and controlled substances, unapproved pharmaceuticals, alcohol, tobacco, vaping products, weapons, explosives, counterfeit goods, stolen data, or human trafficking.
6. Violence, hate and harm: terrorism or violent extremism, threats, glorification of violence, encouragement of self-harm or suicide, or content attacking individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics.
7. Harassment and privacy violations: bullying, doxxing, non-consensual sharing of private information or intimate imagery, or content designed to defame or impersonate a real person or organisation.
8. Intellectual property infringement: pirated software, cracked games, unauthorised media streams or downloads, or links that infringe third-party copyrights, trademarks, or trade secrets.
9. Harmful misinformation: deliberately deceptive content likely to cause real-world physical or civic harm.

Prohibited conduct

You must also not:

• Use bots, scripts, or multiple accounts to manipulate Draws, views, Karma, or leaderboards;
• File false, malicious, or coordinated abuse reports against another User’s Star;
• Modify a Destination page after submitting a Star to introduce prohibited content (“bait-and-switch”);
• Submit spam, keyword stuffing, misleading titles, or repetitive duplicate Stars;
• Scrape, crawl, or overload the Platform, or probe or bypass its security, rate limits, or filters;
• Reverse-engineer the Platform except where applicable law expressly permits; or
• Use the Platform for any unlawful purpose.

How we evaluate compliance. We determine in our sole discretion whether a Star violates this Section by evaluating the Destination URL, its context, the Star’s metadata, and community reports. Only content safe for a general workplace or academic audience is permitted.

6.Your Submissions & Licence to Us

1. You retain ownership. You keep all intellectual-property rights you hold in your Star metadata and your external Destination.
2. Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, format, and distribute your Star’s title, description, category, and URL on the Platform and in promotional showcases of the Platform (such as galaxy screenshots or leaderboards) for as long as the Star is stored, plus a reasonable backup retention period. We do not sell your content.
3. Your representations. When you submit a Star, you represent and warrant that: (a) you own the Destination or have the legal right to share it; (b) the Star and Destination comply with Section 5 and all applicable laws; (c) the metadata you provide is accurate; and (d) you will keep the Destination compliant throughout the Star’s active indexing period.
4. Approved domain whitelist. For user safety, Stars may only link to HTTPS URLs on our approved-domain list (including GitHub, GitLab, X, Reddit, Bluesky, YouTube, Product Hunt, itch.io, Steam, Figma, Substack, Medium, and specific project subdomains on Vercel, Netlify, Cloudflare Pages, GitHub Pages, and Notion). URL shorteners, raw IP addresses, and unapproved external domains are automatically rejected. We may add or remove approved domains at any time without liability or refund.

7.Moderation, Quarantine & Appeals

7.1 Automated pre-screening

Every Star submission is screened automatically before publication: the URL must match our approved-domain whitelist and cannot be a shortener, IP address, or obfuscated mobile share link; the title, description, and URL slug are checked against an explicit/prohibited keyword blocklist; Reddit URLs are verified against Reddit’s public `over_18` metadata flag; and text may be checked via automated safety classifiers. Passing automated checks does not constitute manual approval or waive our right to remove any Star at any time.

7.2 Community reporting

Any User may report a Star using the in-app Report button (rate-limited to 10 reports per 24 hours per reporter). Every report enters our administrative review queue immediately.

7.3 Protective soft-quarantine

If a Star receives reports from 3 or more distinct entities (deduplicated by authenticated account and salted IP hash), it is automatically placed into protective quarantine: it is paused from appearing in public random Draws while awaiting administrator review, while remaining visible in the creator’s own dashboard. If an administrator dismisses the reports as false, the Star is restored to active discovery and marked verified against repeat false quarantine triggers.

7.4 Daily Luckiest Star review gate

When the daily leaderboard resets and selects a candidate for the central Black Hole (“Luckiest Star of the Day”), that candidate is held for administrative verification before being featured at the top of the galaxy. Once approved by an administrator, the Star’s active visibility duration is automatically extended by 24 hours.

7.5 Administrative decisions & appeals

We review reported and quarantined Stars as promptly as practicable. We may dismiss the report, restore the Star, permanently remove the Star, or suspend or terminate the submitting account. We may also remove any Star or terminate any account at any time without prior notice if we determine it violates Section 5 or poses a compliance or safety risk. If you believe your Star was removed in error, you may email codeliminal@gmail.com with the subject “Appeal” within 14 days. Restoration is at our sole discretion, and no refunds are issued under any circumstances (see Section 10).

8.Copyright & Legal Takedown Notices

8.1 Copyright and trademark notices (DMCA & Global IP)

If you believe a Star links to material that infringes your copyright or trademark, email codeliminal@gmail.com with the subject “Takedown Notice” and include:

1. Your full name, mailing address, telephone number, and email address;
2. A description of the copyrighted work or trademark you claim is infringed;
3. The specific Star title/ID on Make Lucky and the offending Destination URL;
4. A statement that you have a good-faith belief the disputed use is not authorised by the rights owner, its agent, or the law;
5. A statement, under penalty of perjury, that your notice is accurate and that you are the rights owner or authorised to act on the owner’s behalf; and
6. Your physical or electronic signature.

We will remove or disable access to the offending Star promptly upon verifying a valid notice and terminate repeat infringers.

8.2 Counter-notices & illegal content reports

If your Star was removed due to a copyright notice by mistake or misidentification, you may submit a counter-notice to codeliminal@gmail.com containing your contact details, identification of the removed Star, a statement under penalty of perjury of good-faith mistake, consent to jurisdiction, and your signature. Anyone may also report unlawful links to codeliminal@gmail.com with the subject “Illegal Content Report.”

9.Premium Subscriptions, Stardust Credits & Payments

1. Merchant of Record & checkout processor. All payments for Paid Features are processed by our authorized third-party Merchant of Record (such as Lemon Squeezy or Polar.sh), which acts as the reseller of record and handles billing, payment security, and applicable digital sales tax/VAT/GST. Their checkout terms and privacy policy also govern your transaction. We never see or store your full payment card details.
2. Pricing. All prices, currencies, and feature allocations are displayed prior to checkout. Applicable taxes may be added at checkout based on your billing location. Stardust credit costs for unlocking additional Star slots or extending active indexing days scale progressively as displayed inside the application before confirmation.
3. Stardust utility credits. Stardust is a limited, non-transferable software usage credit redeemable solely within the Platform to unlock extra Star slots or extend active indexing duration. Stardust has no cash or monetary value, is not a currency, stored-value account, or financial instrument, cannot be redeemed or exchanged for cash, cannot be transferred between users, and cannot be sold.
4. Premium subscriptions. Premium memberships are billed on a recurring subscription cycle and renew automatically at the end of each billing period until cancelled. You may cancel future renewals at any time through your payment receipt customer portal or by emailing codeliminal@gmail.com; cancellation stops future billing charges, and your Premium features remain active until the end of the current paid billing cycle (with no refund or proration for partial periods).
5. Nature of Paid Features. Paid Features provide software capacity (additional Star slots and extended indexing duration in the 3D galaxy). Purchasing Premium or Stardust does not guarantee any number of views, Draws, clicks, or leaderboard placements, and never exempts a Star or account from Section 5 or from moderation.

10.Strict No-Refund Policy (All Sales Final)

10.1 Express waiver of statutory withdrawal rights

By ticking the agreement checkbox and completing a checkout transaction, you expressly request immediate provisioning and delivery of the digital software service/credits and acknowledge that you waive and lose any statutory right of withdrawal or cooling-off period (including the 14-day withdrawal period under EU/UK consumer directives or similar international laws) once the digital utility is provisioned to your account.

10.2 No refunds for moderation, Star removal, or unused credits

Without limiting the generality of the above, you will NOT receive any refund, partial credit, proration, reimbursement, or compensation in any of the following situations:

1. Policy Violations & Star Removal: If your Star is quarantined, suspended, or permanently removed, or your account is terminated, for violating Section 5 (Acceptable Use & Content Policy) or any other provision of these Terms;
2. Unused Stardust or Uncancelled Subscriptions: If you choose not to spend purchased Stardust credits, forget to cancel a recurring Premium subscription before its renewal date, close your account, or stop using the Platform;
3. Traffic & Discovery Expectations: If you are dissatisfied with the number of random Draws, views, clicks, or Karma points your Star receives;
4. Accidental Purchases or Change of Mind: If you purchase Premium or Stardust by mistake or change your mind after payment; or
5. Temporary Quarantine or Maintenance: If your Star is temporarily paused during community-report quarantine or routine Platform maintenance.

10.3 Chargebacks and payment disputes

Initiating a chargeback or payment dispute with your bank or card issuer after purchasing a digital feature on Make Lucky is a material breach of these Terms. If you file a chargeback: (a) your account and all associated Stars will be immediately and permanently banned; (b) all Stardust and Premium benefits will be forfeited; and (c) we will submit timestamped proof of your clickwrap acceptance of this Strict No-Refund Policy, your session/IP logs, and proof of instant digital provisioning to the Merchant of Record and card network to contest the dispute.

11.Privacy Policy

This section explains what personal data we collect, why, and your rights. Purnendu Gharami is the data controller responsible for your personal data on the Platform.

11.1 What we collect

• Account data: name, email address, password (stored securely as a cryptographic hash by our authentication provider) or, if you sign in via Google or X (Twitter) OAuth, the basic profile data they share (name, email, avatar URL).
• Profile and activity data: your submitted Stars, platform/category preferences, Karma, Stardust balance, subscription tier, Draws, Stars you visit or support, abuse reports you file, and email notification preferences.
• Purchase data: order IDs, subscription status, products purchased, amounts, and dates received via webhook from our Merchant of Record (Lemon Squeezy / Polar.sh). We never receive or store your payment card number.
• Technical and safety data: a signed session cookie identifier (lucky_sid) and a salted one-way cryptographic hash of your IP address (used strictly for rate limiting, preventing report brigading, and anti-abuse security), browser/device metadata, and server logs.
• Communications: emails you send to codeliminal@gmail.com.

11.2 What is public

Your Star metadata (title, description, category, Destination URL, view/Draw counts), your public display name and avatar shown on your Stars and leaderboards, and your display name when you support another creator’s Star are visible to other visitors. Do not include confidential personal information in your display name or Star submissions.

11.3 How we use your data (and legal basis)

• To operate the Platform — accounts, Star indexing, Draws, leaderboards, and Paid Features (performance of our contract with you);
• To maintain Platform security — automated moderation, rate limiting, anti-brigading quarantine, and enforcing these Terms (legitimate interests and legal obligations);
• To process orders, maintain accounting records, and comply with legal obligations (legal obligations);
• To send essential transactional and security emails (contract / legitimate interests); and
• To send optional product updates only if you opt in, which you may unsubscribe from at any time (consent).

We do not sell your personal data or share it for third-party cross-context behavioural advertising.

11.4 Service providers we share data with

We share data only with essential infrastructure sub-processors required to run the Platform:

• Supabase — database storage and authentication;
• Cloud hosting provider (Vercel / Cloudflare) — web application delivery and edge security;
• Merchant of Record (Lemon Squeezy / Polar.sh) — checkout billing, tax compliance, and invoicing;
• Resend — transactional email delivery;
• Google & X (Twitter) — optional OAuth sign-in authentication;
• OpenAI Moderation API — automated safety classification of submitted Star titles, descriptions, and URLs (no user account data is transmitted); and
• Reddit API — querying public JSON metadata when a Reddit URL is submitted to verify it is not marked `over_18`.

11.5 International data transfers

We operate from Bangladesh and our cloud infrastructure providers process data globally, including in the United States and the European Union. By using the Platform, you acknowledge and consent to the transfer and processing of your information across these jurisdictions.

11.6 Cookies and local storage

We use only strictly necessary cookies and browser storage: an authentication session cookie, a signed session cookie (lucky_sid) for rate limiting and Draw deduplication, and browser local/session storage for UI preferences. We do not use third-party advertising tracking cookies.

11.7 Data retention & your privacy rights

Account data is retained until you request deletion (and purged within 30 days). Transaction records are retained as required for tax and anti-fraud compliance, and hashed IP/security logs are kept for up to 90 days. Depending on your jurisdiction (including under the EU/UK GDPR and CCPA), you may request access to, correction of, or deletion of your personal data by emailing codeliminal@gmail.com from your registered email address. We respond to verified requests within 30 days.

12.Our Intellectual Property

The Platform’s name, branding, 3D galaxy shaders, software code, visual design, and text (excluding User-submitted Star metadata) are owned by Purnendu Gharami and protected by international copyright and intellectual-property laws. You receive a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform strictly in accordance with these Terms.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Purnendu Gharami and any affiliates, payment processors, and service providers of the Platform from any third-party claims, damages, liabilities, regulatory fines, payment-processor penalties, chargeback fees, losses, and reasonable legal expenses arising out of or related to: (a) any Star or URL you submit; (b) your breach of these Terms; or (c) your violation of any law or third-party right.

16.Suspension & Termination

1. By you. You may stop using the Platform and request account deletion at any time by emailing codeliminal@gmail.com.
2. By us. We reserve the right to suspend or terminate your account or remove any Star at any time, with or without notice, if you violate these Terms, if required by law or our payment partners, if your activity creates risk for the Platform, or if we discontinue the Platform.
3. Effect of termination. Upon termination for any reason, your right to use the Platform ceases immediately and all unused Stardust credits or remaining subscription periods are forfeited without refund (Section 10). Sections 6.2, 10, 12–15, 17, and 19 survive termination.

17.Governing Law & Disputes

1. Informal resolution first. Before initiating any formal legal proceeding, you agree to email codeliminal@gmail.com with the subject “Dispute” and a detailed description of the issue, and allow us 30 days to resolve it informally.
2. Governing law. These Terms and any dispute arising out of or relating to the Platform shall be governed by and construed in accordance with the laws of Bangladesh, without regard to conflict-of-law principles.
3. Exclusive jurisdiction. Any legal suit, action, or proceeding arising out of or relating to these Terms or the Platform shall be instituted exclusively in the competent courts located in Dhaka, Bangladesh, and you irrevocably submit to the personal jurisdiction of such courts.
4. Time limit on claims. To the maximum extent permitted by law, any claim or cause of action arising out of or related to the Platform or these Terms must be filed within one (1) year after such claim arose, or be permanently barred.

18.Changes to the Platform & These Terms

1. Platform updates. We may modify, update, add, or discontinue any software feature of the Platform at any time without liability.
2. Updates to these Terms. We may revise these Terms at any time by posting the updated version on this page and updating the “Last Updated” date above. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

19.General Provisions

• Entire agreement. These Terms, together with any terms presented at checkout, constitute the entire agreement between you and us regarding the Platform.
• Severability & no waiver. If any provision of these Terms is held invalid, the remaining provisions remain in full force. Failure to enforce any provision does not waive our right to do so later.
• Assignment. You may not assign or transfer your account or rights under these Terms. We may freely assign or transfer these Terms, the Platform, and associated data to a buyer, affiliate, or successor.
• Force majeure. We are not liable for delays or outages caused by events beyond our reasonable control, including internet, cloud hosting, database, or third-party API failures.
